General Terms and Conditions of Business (terms and conditions for webshop)
1. Purpose
These General Terms and Conditions of Business apply to the sale and delivery of all goods offered by our online shop, namely books, music CDs, art products (unique prints / graphic art / photos, art cards / art calendars, etc.)
These General Terms and Conditions form an integral part of every agreement for the sale or delivery of goods ordered from the online shop or by e-mail. When ordering goods via the online shop, the customer accepts these General Terms and Conditions without reservation.
2. Receipt of orders
The goods offered for sale can be ordered directly in the webshop or separately by e-mail.
3. Conclusion of contract
Your order will be confirmed by e-mail, fax or by post. Our order confirmation with details of the item ordered and the price is regarded as equivalent to the conclusion of a sales contract and acceptance of the request and is binding.
4. Prices
Prices are quoted in Swiss Francs. All prices quoted exclude VAT as we have not yet reached the turnover threshold for VAT registration. We reserve the right at all times to adjust the prices and General Terms and Conditions of Business should the turnover threshold for VAT registration be reached.
5. Forwarding costs
Within Switzerland included.
Europe and other countries on request.
6. Payment terms - payment agreements
By credit card (MasterCard, Visa). Cash payments or invoice payments by arrangement only.
7. Reservation of proprietary rights
The delivered goods remain the property of CREANDO until payment has been received in full. CREANDO is authorised at any time to have the reservation of proprietary rights entered in the register provided for this purpose.
8. Quality guarantee
The goods are carefully packaged and despatched and leave the premises of CREANDO in perfect condition. On receipt, the customer should immediately check the goods for damage. The forwarding agent or postal service and CREANDO must be advised of any damage to the packaging and/or the goods in writing immediately and a confirmation must then be sent in writing, otherwise the forwarding insurance loses its validity. The customer is responsible for providing proof of immediate notification.
9. CopyrightAll books, music CDs, photos, graphics, pictures and other information and texts published on the website are subject to the copyright of Gottlieb Guntern or Greta Guntern-Gallati – unless marked otherwise. It is expressly forbidden to copy, disseminate, save and reproduce or transmit the content or the source code of the website without prior written approval.
The ownership of copyright for the website design, including HTML and JavaScript code, belongs to the CREANDO Foundation and may not be copied or used in any other way.
10. Cancellation
The customer is authorised to cancel his declaration of intent on the contract without giving any reasons for doing so within 14 days of receipt of the goods in text form (e.g. letter, e-mail) and to send the goods back to CREANDO. The cancellation period begins on the day of receipt of the goods by the recipient. The punctual despatch of the cancellation and the goods is sufficient to meet the cancellation deadline. The cancellation is to be sent in writing to:

or by e-mail to info@creando.org. The customer is responsible for providing proof of return of the goods. He/she is responsible for any sort of damage and loss of value of the goods.
In the event of a valid cancellation, both parties must refund the services already received. If the customer can only return the received goods in a less than perfect condition, he/she must compensate CREANDO in full for the loss in value.
The customer shall bear the costs and risk of returning the goods unless the goods delivered do not correspond with the goods ordered.
CREANDO reserves the right to retain the payment already received for the goods until the goods are returned. The customer agrees that CREANDO may offset any demands resulting from loss of value or deterioration of the goods against the purchase price received.
The right of cancellation is excluded for contracts
• concerning the delivery of CDs unless they are returned unused and sealed in the original packaging;
• concerning the delivery of goods which were prepared in accordance with the customer's specifications
(e.g. fine art prints, digital prints, other reproductions).
If the right of cancellation and right to return the goods are excluded, the customer must pay the costs of sending out the goods to him/her again in advance. Otherwise CREANDO is authorised to keep the goods at the disposal of the customer for a period of 6 months. After this period, CREANDO is authorised to dispose of the goods without further ado and without refund.
11. Data protection
All personal customer data will be treated as confidential and not passed on to third parties.
12. Court of jurisdiction and applicable law
The court of jurisdiction is Brig. All legal relationships are governed exclusively by Swiss law. The parties reserve the right to require the written form and joint signatures as an absolute condition of validity outside these General Terms and Conditions. No oral collateral agreements have been made between the parties.
